mailBANK Terms of Use

mailBANK users agree to comply with the Australian Government Spam Act 2003.

The Spam Act is based around three key conditions that govern the sending of all commercial emails.  All commercial emails must meet the following conditions:

  • consent -  the message must be sent with the recipient's consent. The recipient may give express consent, or under certain circumstances consent may be inferred from their conduct or an existing business or other relationships
  • identify - the message must contain accurate information about the person or organisation that authorised the sending of the message and how to contact them
  • unsubscribe -  the message must contain a functional 'unsubscribe' facility to allow the recipient to opt out from receiving messages from that source in the future. The unsubscribe requests must be honoured within five working days.

mailBANK reserves the right to refuse or to cancel the registration of the mailBANK Service for any subscriber which it considers is guilty of misuse, at its discretion alone.

For every e-mail message sent using the mailBANK Service, you agree that an image stating "Created with mailBANK" or a similar message will appear at the foot and that this image will contain a link to the mailBANK website.

You are responsible for monitoring, correcting and updating the e-mail addresses to which messages are sent by you using the mailBANK Service.

You may terminate this agreement at any time. mailBANK will delete any of your archived data within 30 days after the date of termination. No fees will be applied for termination and no rebates will be given for payments made in advance for any unused period.

mailBANK reserves the right to suspend or terminate the mailBANK Service if fees are not paid by the date due.

To the extent allowable by law, mailBANK expressly excludes and disclaims all liability, loss or damage of any kind in relation to your use of the mailBANK Service. mailBANK has security measures in place to protect the loss, misuse and alteration of the information under its control. However mailBANK shall not be held responsible if others unlawfully obtain access to that information. mailBANK does not warrant that the mailBANK Service will be uninterrupted or error-free; nor does it make any warranty as to the results that may be obtained from use of the mailBANK Service.
